Acts as a legal advisor and attorney for the state/territory National Guard, responsible for the formulation of state/territory legal policy and its execution legal representation; legal initiatives; interpretation and litigation of U.S. and state/territory(s) constitutional, civil, criminal, labor law; international law and treaty agreements; trial defense; and a full spectrum of expert legal advice. Assignments include some of the most diverse, complex, difficult and emerging legal issues found in any area of law, to include: homeland security, emergency response, sovereignty, state/territory compacts, fiscal and contract law, civil affairs, employer support, military statute and administrative law (Federal & state/territory), non-military employment law (Federal & state/territory), administrative law, environmental law and emerging areas of law, i.e. domestic operations, intelligence law, weapons of mass destruction emergency response and assistance to civil authorities, etc. Counsel provided covers the full spectrum of legal and organizational concerns, frequently involving the most politically and legally substantive, sensitive and privileged issues faced by senior public sector leaders. Responsible to advise on the legal, factual and other impacting aspects of drafting, interpretation and application of legislation, regulation, tasking orders, decision, opinions or other guiding, or lack thereof, instruments associated with emerging or highly conflicted and emotionally charged issues such as intelligence oversight related to Homeland Security, or advising on Federal and state/territory Executive Orders for the use of federalized troops in response to domestic emergencies and natural disasters. These include interagency (Federal-to-Federal, Federal-to-state/territory and state/territory-to-local) homeland security & emergency management initiatives, policy, legislative proposals or implementation plans. Advises appointed and elected leaders on the appropriate use of National Guard personnel, resources and status issues for critical and diverse missions, emergency responses, contingencies and exercises, ensuring execution is consistent legislative intent, executive orders, current U.S. Codes and state/territory laws, court decisions and agreements. Serves as the state/territory National Guard litigation point of contact. Represents the state/territory National Guard in all legal matters in state/territory and Federal courts of original or appellate jurisdictions. Serves as an attorney/advisor providing acquisition and fiscal legal advice to the state/territory's assigned United States Property & Fiscal Officer (the Chief of the National Guard Bureau's agent in the state/territory) and active duty military advisors. Advises Army National Guard (ARNG) and Air National Guard (ANG) contracting officers, reviews contracts, procurement actions and real property matters involving Federal and state/territory funds (some involving substantial amounts of money) for legal sufficiency, appropriate titling and claim initiation or resolution actions. Acts as the Adjutant General's representative in third-party proceedings under Federal labor-management and equal employment opportunity statutes and regulatory provisions. Represents the state/territory National Guard as a trial attorney on assigned cases before investigators, administrative judges and arbitrators from various appellate bodies including, but limited to, the Equal Employment Opportunity Commission, the Federal Labor Relations Authority, the Federal Services Impasses Panel and Federal Courts. Possesses a thorough understanding of controlling labor laws, regulations, labor arbitration, collective bargaining agreements and pertinent labor relations practices. Reviews collective bargaining agreements for legal sufficiency. Advises the convening authorities, including the state/territory Adjutant General, on procedural and legal issues associated with Courts Martial, Non-Judicial Punishment Administrative Board proceedings and subsequent actions. Serves as the state/territory Ethics Advisor. Serves as claims officer for the state/territory National Guard. Reviews Claim Investigating Officer reports, adjudication recommendations, regardless of filing location, and approves forwarding of actions to the appropriate claims office. Provides oversight and guidance to the state/territory Judge Advocate's Legal Office, Legal Assistance and Preventative Law Programs, and supervises assigned full-time attorney and support staff. Also coordinates the provision of legal services throughout the state and oversees the assignments of attorney and paralegal personnel within the subordinate units in both the Army and Air National Guard to accomplish all legal support requirements. Performs other duties as required.
Specialized
Experience: Must have at least 36 months experience, education or training in the preparation of cases for trial and/or tries cases before a court or an administrative body of persons having quasi-judicial power, the rendering of legal advice and services with respect to questions, regulations, practices or other matters falling within the purview of a Federal Government, the preparation of interpretive and administrative orders, rules, or regulations to give effect to provisions of governing statutes or other law requirements. Skill in analyzing, discussing and providing oral and written counsel on complex legal arguments in a representative capacity in a manner that aids the recipient in understanding the issues, options, and recommended courses of action.The incumbent for this position must possess the following minimum requirements:
Minimum Requirements:
A. A law degree (LLB or J.D.) from a law school accredited by the American Bar Association.
AND
B. Bar Membership: Be an active member in good standing of a state, territory of the United States, District of Columbia, or Commonwealth of Puerto Rico Bar, with the demonstrated intent to become a member of the Alaska Bar.

APPOINTMENT FACTORS: Excepted/Officer in the Alaska Army / Air National Guard.
MILITARY COMPATIBILITY: If you are selected for this position, you will be required to become a member of the Alaska Air National Guard and be assigned to a compatible military assignment in the following Army MOSs/Series: 27A; or Air AFSC: 51JX.
MILITARY GRADE REQUIREMENT: Due to the nature of this position, the minimum grade of this position is Major (MAJ/04).
DESIRABLE: Alaska Bar Membership.
INDEFINITE: AKNG permanent technician will retain their permanent status if selected for this position, and may be promoted, reassigned or changed to lower grade if selected for this position, and will be required to return to their permanent position unless action is made on a permanent basis. Permanent authorization may not cross service boundaries, or funding categories, (i.e., ARNG to ANG, or 176thWG to 168th WG). Indefinite employees may be separated with a 30 days' notice. Indefinite employees may be converted to permanent without further competition.

The check can be for multiple reasons such as signing bonus, supplies, etc. The victim will be instructed to deposit the check and use the money for any of these reasons and then instructed to send the remaining funds to the fraudster. The check will bounce and the victim is left responsible.
